TERMS AND CONDITIONS

These General Terms and Conditions (the “Terms”) set out the terms of the support agreement between MITOE – the National Association of Property Owners and Condominiums in Hungary, as beneficiary (the “Donee”), and persons providing financial support online through the designated interface (the “Donation”; the Donee and Donor together, the “Parties”). These Terms govern donations made by cash-substitute payment instrument (bank card) and bank transfer through https://www.mitoe.hu/ (the “Website”), maintained and operated by the National Association of Property Owners and Condominiums in Hungary. By donating, the Donor supports the Association’s public-benefit objectives. The National Association of Property Owners and Condominiums in Hungary (the “Association”) aims to represent the interests and professional concerns of audit committee members of Hungarian condominiums before legislators, authorities and local governments, and to promote and improve the professional standard of condominium operations and audit committee work.

2. Definitions

Donor: a natural person, legal entity or organisation without legal personality that uses the donation option available on the Association’s Website.

Fundraising: an activity carried out by the Donee, or a person authorised by it, to generate resources for achieving its core or public-benefit objectives;

Donation interface: the Association’s website https://www.mitoe.hu, where donations are made by cash-substitute payment instrument (bank card) or bank transfer.

Donee: the Association collecting the Donation for its core or public-benefit objectives;

Donation: support or a grant provided during the tax year without a repayment obligation, the book value of an asset transferred free of charge, or the cost of a service provided free of charge to support the public-benefit activities of a public-benefit organisation under the Hungarian Civil Organisations Act (Ectv.), provided that it confers no financial advantage beyond those specified in the Corporate Tax Act (Tao. tv.) on the donor, its member or shareholder, senior officer, supervisory board or board member, auditor, or a close relative of any such person or of a natural-person member or shareholder. A reference to the donor’s name or activities does not count as a financial advantage. Accordingly, only a public-benefit organisation may receive a Donation;

Publication of accounts: the organisation must submit its accounts approved by the authorised body and its public-benefit annex, together with the auditor’s report where an audit is mandatory, to the National Office for the Judiciary (OBH) for deposit and publication by the last day of the fifth month following the balance sheet date of the financial year concerned. If the civil organisation has its own website, the accounts and public-benefit annex must also be posted there, and the published information must remain continuously accessible at least until publication of the information for the second financial year following publication;

Civil organisation: a foundation or association, excluding a political party or civil partnership;

CNP transaction: a virtual “card not present” transaction that allows goods or services to be purchased through an online virtual POS terminal (e-commerce), by telephone or by post (MO/TO), with the cardholder providing their card number, expiry date and CVC2 code to the merchant. Some acquiring banks may require further information, such as the issuing bank’s name or the cardholder’s name as printed on the card.

Public-benefit annex: civil organisations and their organisational units with legal personality prepare the annex specified in section 29(3) of the Ectv.; public-benefit organisations and their organisational units with legal personality prepare the annex specified in section 46(1) of the Ectv., at the same time as approving the accounts, using the form prescribed in the annex to Government Decree 350/2011 (XII. 30.) on the financial management of civil organisations, fundraising and certain matters concerning public-benefit status. Public-benefit activity: any activity that directly or indirectly serves a public task specified in the founding document and thereby contributes to meeting the common needs of society and individuals;

Visitor: a person who views all or part of the Website’s content;

Service provider: for card donations, the provider operating the payment interface is the Barion payment system (https://www.barion.com/hu/). 3. Formation of the agreement

A donation agreement is formed when the Donor provides support to the Donee through one of the support options described on the Website, using a payment method described in these Terms and listed on the Website. The Donor provides the Donation to the Donee without seeking consideration in return.

The Donor provides a Donation to the Association by bank transfer or online payment on the Website. Providing support and accepting these Terms creates an individual support agreement between the Donor and the Association for that contribution. The Donor decides independently, voluntarily and without undue influence whether to support the Association and, if so, when, how and in what amount.

Each further contribution between the same Parties under these provisions creates a separate individual agreement. The agreement is not deemed to be concluded in writing. It is entered into for a fixed term and ends upon performance, namely transfer of the Donation.

4. Subject matter and content of the agreement

4.1. The Parties agree that the purpose of the Donation is to assist the Donee, MITOE – the National Association of Property Owners and Condominiums in Hungary, and support the public-benefit objectives and activities set out in the Association’s statutes.

4.2 Methods of donating

4.2.1 For a bank transfer, please provide your bank with the following details: Account holder: MITOE – Magyarországi Ingatlantulajdonosok és Társasházak Országos Egyesülete. Bank account: Raiffeisen Bank Zrt., 12010611-01883954-00100009. Donation amount: … HUF. Payment reference: “name + adomány” (donation), or for membership fees, “name + tagsági díj” (membership fee).

4.2.2 Card payment with Barion: Users may pay their chosen donation amount online by bank card through the secure payment system of the financial service provider used by the Association. Online card payments are processed through Barion. Card details are not transmitted to the Association. Barion Payment Zrt. is supervised by the Hungarian National Bank under licence H-EN-I-1064/2013. The Donor may start donating without registration and confirms acceptance of these Terms and the Privacy Notice. Before being redirected to Barion, the Donor can enter personal details on the Website (name, email address and optionally town or city), and specify the amount and purpose of the Donation. After entering the details and accepting the Terms and Privacy Notice, the Donor is redirected to Barion, where further details are required to complete the Donation.

Barion’s dedicated interface allows Donations of predefined or individually chosen amounts and also allows recurring Donations to be set up. Recurring Donations can be modified or cancelled within the Barion payment system.

Payment through the Barion payment system is free of charge.

Registration with Barion is free but optional. If you already have a Barion wallet or account, you do not need to register again.

Donations can also be made through Barion without registration, by entering card details only. In this case, Barion registration is not required, but Barion’s Terms and Conditions must be accepted.

Bank cards accepted by Barion: Mastercard, Maestro, Visa, Electron or Amex (…).

Card details entered in Barion are not forwarded to the Association and are processed solely by Barion. Neither the Association nor Barion Payment Zrt. has access to the bank card details. The Association is directly responsible for recurring payment transactions initiated incorrectly or without authorisation; no claim may be asserted against the Association’s payment provider, Barion, in that respect.

For card payments, Barion processes the personal data entered in its payment system under its current policies. The Association accepts no responsibility for processing data entered in Barion’s system. After payment, the user is redirected from Barion to the fundraising Website, where the result of the card transaction is displayed. Online card payments are processed through Barion, and card details do not reach the Association. Barion’s server security is designed in accordance with Hungarian National Bank requirements. 4.3 By accepting the Donee’s Privacy Notice and making a card Donation, the Donor consents to the following processing necessary to execute the payment: Barion Payment Zrt. processes personal data entered on the barion.hu payment interface under its Privacy Notice (https://www.barion.com/hu/adatvedelmi-tajekoztato/) and sends us information on the successful Donation, the donated amount and the payment date.

5. Termination of the agreement

5.1. The agreement ends upon performance.

5.2. For a one-off Donation, the donation agreement ends upon performance. For recurring Donations, the Parties’ support agreement is indefinite, but the Donor may terminate it at any time with immediate effect and without giving reasons, with effect for the future. No right of withdrawal may be exercised in respect of a Donation already completed.

6. Complaints procedures

6.1. Users may raise complaints concerning the Service Provider’s donation-related activities using the following contact details:

The Association investigates oral complaints immediately and remedies them where necessary, if the nature of the complaint permits. If the User disagrees with the handling of the complaint, or immediate investigation is not possible, the Association promptly records the complaint and its position on it. A copy is given to the User on the spot for an in-person complaint; for a telephone complaint it is sent no later than the substantive response described under written complaints. The complaint is then handled under the rules for written complaints.

The Association must examine and provide a substantive response to a written complaint within thirty days of receipt and ensure that the response reaches the User. If the complaint is rejected, the Association must give reasons in its substantive response.

The Association must retain the complaint record and a copy of its response for five years.

The Association receives complaints at the contact details listed in this section during the management office’s opening hours.

The Association undertakes to seek mutual agreement in disputes and to cooperate towards a resolution acceptable to both parties.

7. Final provisions

The Association may receive Donations or membership fees only by the methods listed in these Terms, unless otherwise agreed in advance.

Matters not governed by these Terms are subject to Government Decree 350/2011 (XII. 30.) on the financial management of civil organisations, fundraising and certain matters concerning public-benefit status; Act CLXXV of 2011 on the Right of Association, Public-Benefit Status, and the Operation and Support of Civil Organisations (Ectv.); and Act V of 2013 on the Civil Code (Ptk.).

The Association may amend these Terms unilaterally. It provides continuous access to the currently effective Terms on its website.
